An account with IOTA Diagnostic: 

For purchasing IOTA Diagnostic’s products & services, to enable IOTA Diagnostic to gather User information, a User may or may not have an account with IOTA Diagnostic. IOTA Diagnostic starts gathering the User’s information once a User visits the Website and feeds data therein or IOTA Diagnostic may also gather information from its business partners. Creating a user ID, and strong password, changing the password, and updating or modifying the personal information on the Website should be handled by the User independently. It is important that the details you provide to IOTA Diagnostic are correct, accurate and complete and that you promptly update your Account as necessary. IOTA Diagnostic along with its associates, affiliates, and business partners own and/ or acquire certain trademarks, Word Marks and other technical information (“IPR”) which may be disclosed on the Website. The User cannot reproduce, duplicate, cross-engineer, reverse engineer or recreate a similar or identical IPR. Please note that the Company does not access, store or keep any payment-related data or information. All payment transactions happen using Secure Server Software through third-party payment gateways and the Company does not have any control over the payment transactions, except for directing you to the payment gateway. Accordingly, the Company shall in no way be responsible or liable for any loss or damage due to any disclosure of your payment-related information.

The Company hereby disclaims all its liability and shall in no way be liable or responsible for any loss or damage caused to you on account of intentional or unintentional disclosure of any Personal Information concerning your account and/or any information with respect to the online payment transaction using the credit card/debit card/cash card/net-banking/mobile wallet/UPI, etc. and/or the payment verification process.

Governing Law and Jurisdiction

These Website Policies are governed by and construed in accordance with the laws of India. Any and all disputes arising from this Privacy Policy and the Terms and Conditions of Use will be subject to arbitration to be conducted by an independent sole arbitrator (who shall be a retired judge/judicial officer) to be appointed by the Company. The arbitration shall be conducted in accordance with the provisions of the Arbitration and Conciliation Act, 1996 (as amended). The arbitration shall be conducted in Ahmedabad and in the English language. Subject to arbitration, the jurisdictional courts at Ahmedabad shall be entitled to grant interim relief/injunction. By using the Website, you hereby irrevocably agree to these terms including the jurisdiction.

Disclaimer

The Company does not access, store or keep credit card data. All credit card transactions happen using Secure Server Software (SSL) for 128-bit encryption through third-party gateways and the Company plays no role in the transaction, except for directing the customers to gateways or relevant webpages. Accordingly, the Company shall not be responsible or liable for any loss or damage due to any disclosure whatsoever of Personal Information. 

The Company shall not be liable for any loss or damage sustained by reason of any disclosure (inadvertent or otherwise) of any Personal Information concerning the User’s account and/or information relating to or regarding online transactions using credit cards/debit cards /cash cards and/or their verification process and particulars nor for any error, omission or inaccuracy with respect to any information so disclosed and used.  

IOTA Diagnostic does not provide medical advice or any type of prescription. Users are requested to discuss with the physician, or doctor of their choice, and read and understand the terms of service, and product usage before purchasing the products or services of IOTA Diagnostic. IOTA Diagnostic engages third-party service providers as and when required. IOTA Diagnostic does not warrant or guarantee the accuracy or completeness of such third-party service providers. The User may engage the service provider, transporter, Doctor, or phlebotomist of their choice.
